Public access to documents

Rules for access to documents in possession of the EUDA

The EU Treaties and the Charter of Fundamental Rights of the EU give the public the right to ask for copies of documents possessed by EU institutions, bodies, offices and agencies (EUIABs) and these EUIABs must grant access to requested documents, except in certain limited circumstances set out in European law and rules. The general rules giving effect to this right are set out in Regulation (EC) No 1049/2001, which is applicable to the EUDA, in accordance with Art. 47 (1) of its Regulation (EU) 2023/1322. This legal framework reflects the EU's commitment to transparency and good administrative practice, while safeguarding legitimate interests such as public security, defense and data protection.

At the EUDA there are rules for the implementation of the above-mentioned Regulation (EC) No 1049/2001, which were adopted by the Management Board of the Agency in January 2006.
